Welcome to Nostrum Electric India Pvt. Ltd. Company These Terms & Conditions govern your access to and use of our IoT mobile application Nostrum Smart Home and any related services, software, or connected products (collectively referred to as the “Services”).
By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree, please do not use the App or Services.
Eligibility
You must be at least 18 years old to use the App. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
License & Access Rights
Nostrum Electric India Pvt. Ltd. grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for personal, non-commercial use in connection with Nostrum smart devices.
You agree not to:
Reverse-engineer, decompile, or modify any part of the App.
Use the App for any unlawful or unauthorized purpose.
Interfere with the App’s security features or its communication with connected devices.
Account Registration & Security
To access certain features, you may need to create an account by providing valid contact information (e.g., name, email, phone number).
You are responsible for maintaining the confidentiality of your login credentials.
You must immediately notify us of any unauthorized access or security breach.
Nostrum Electric India Pvt. Ltd. will not be liable for any loss or damage resulting from your failure to maintain account security.
Device Connectivity & IoT Integration
The App allows you to control, configure, and monitor IoT-enabled devices
approved by Nostrum Electric India Pvt. Ltd.
Connectivity and performance depend on factors such as internet connectivity, power supply, and compatibility with other smart systems.
The Company shall not be held responsible for operational interruptions due to network outages, hardware incompatibility, or third-party service disruptions.
Software Updates
The Company may periodically release software or firmware updates to enhance functionality or security.
You agree to install all available updates promptly. Continued use of outdated versions may result in limited functionality or disconnection from the platform.
Data Privacy & Usage
By using the App, you agree to our Privacy Policy, which explains how we collect, store, and process your data.
The App may collect data such as:
Device usage patterns
Application analytics
Performance logs and error reports
Such data is used to improve product performance and user experience.
We do not sell or disclose personal data to third parties, except as required by law or to trusted service providers under confidentiality agreements.
Intellectual Property Rights
All intellectual property, including but not limited to logos, designs, source code, software architecture, product interfaces, and brand names, are the exclusive property of Nostrum Electric India Pvt. Ltd.
You are prohibited from copying, distributing, or exploiting any part of the App or its content without written permission.
User Conduct
You agree not to use the App for purposes that are:
Illegal or fraudulent;
Intended to harm, disable, or disrupt networks, servers, or connected devices;
Misleading, defamatory, or infringing upon others’ rights;
Interfering with other users’ enjoyment of the Services.
Violation of these terms may result in suspension or permanent termination of your account.
Third-Party Integrations
The App may interface with third-party platforms such as Google Home, Alexa, or Apple HomeKit.
Nostrum Electric India Pvt. Ltd. is not responsible for the functionality or data handling of these third-party services.
Use of such integrations shall be governed by the respective third party’s terms and privacy policies.
Limitation of Liability
To the fullest extent permitted by law:
Nostrum Electric India Pvt. Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use the App.
The Company’s total liability for any claim shall not exceed the amount paid by the user (if any) for the App or Services.
We make no warranties, express or implied, regarding uninterrupted or error-free operation.
Warranties Disclaimer
The App and Services are provided “as is” and “as available”, without warranties of any kind. We do not warrant that:
The App will be compatible with all devices or networks.
Errors or defects will be corrected immediately.
The data transmitted will always remain secure from unauthorized access.
Termination
The Company reserves the right to suspend or terminate your account or access to the App at any time, without notice, if we believe you have violated these Terms.
Upon termination, your right to use the App ceases immediately.
Indemnification
You agree to indemnify and hold harmless Nostrum Electric India Pvt. Ltd., its directors, employees, and affiliates from any claims, damages, or expenses arising out of your use or misuse of the App or violation of these Terms.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
Modifications to the Terms
Nostrum Electric India Pvt. Ltd. reserves the right to modify or update these Terms at any time. Revised Terms will be published within the App and become effective upon posting. Continued use after such changes constitutes your acceptance.
